We instructed Rob and his team to design a drainage strategy for our New Build in Plymouth. The LLFA raised several points that needed addressing which Rob made a priority to complete. Even though our Architect wanted to proceed to full planning with a pre condition, Rob eventually managed to address all points raised and we now have full planning permission approved by the LLFA. Our build is very complex and Rob overcome every hurdle. We can’t thank Rob and his team enough for their dedication and expertise.

What is a Section 38 agreement?

A Section 38 agreement, under the Highways Act 1980, is how a new estate road built by a developer becomes a publicly maintained highway. The highway authority approves the design, the road is built and inspected, a maintenance period follows, and adoption completes at the end of it.

What is the difference between Section 38, 278 and 184?

Section 38 covers adoption of new roads. Section 278 covers alterations to the existing public highway — a new junction, a widened carriageway, a signalised access. Section 184 covers a vehicle crossing over the footway, which is what most single-dwelling accesses need.

How long does highway adoption take?

The technical approval stage typically runs a few months depending on the authority. Adoption itself completes only after construction and a maintenance period, so the overall process is usually measured in years rather than weeks. The design and technical approval are the parts we control.

Do I need swept path analysis?

If refuse vehicles, delivery vehicles or fire appliances need to reach your development and turn, then yes. Highway authorities routinely ask for it, and it is far cheaper to establish that a refuse vehicle cannot turn at design stage than after the kerbs are in.

If your scheme discharges to a ditch, brook or culvert, you may also need ordinary watercourse consent — a separate consent from planning that is easy to miss.
